By using the services of GCMS Notes Request, you agree to the following terms and conditions:
GCMS Notes Request is a private service that, with explicit written consent, submits Access to Information and Privacy Act (ATIP) requests on behalf of clients to Canadian government institutions such as IRCC, CBSA, or CSIS.
We act solely as authorized requesters under the Privacy Act for the purpose of obtaining a client’s personal information. We do not offer any immigration advice or legal representation and are not authorized representatives as defined by Immigration, Refugees and Citizenship Canada (IRCC). GCMS Notes Request is not affiliated with any Canadian Government Agency.
Handling of Personal Information
We process and transmit personal information solely for the purpose of requesting immigration-related documents (e.g., GCMS notes or case files) from Canadian government institutions.
Documents received from IRCC, CBSA, or other agencies are delivered to you as-is, with no modification, alteration, redaction, or summarization.
All electronic files and sensitive information are securely stored and deleted after 25 calendar days from delivery to the client, unless legally required to retain them longer. GCMS Notes Request adheres to the Personal Information Protection and Electronic Documents Act (PIPEDA) for the collection, storage, and disposal of personal data.
Consent
By using our services, you grant GCMS Notes Request and its designated agents permission to act as your authorised requester solely for the purpose of submitting access to information requests on your behalf. This includes the use of your personal information and identification documents to prepare and submit formal requests, and to communicate with the appropriate Canadian government institutions as required.
Where legally required (e.g., for Privacy Act requests), you agree to complete and sign the required consent forms authorizing us to obtain your personal information from IRCC, CBSA or CSIS.
Pricing and Payments
All prices listed on our website are in CAD and subject to applicable taxes. We reserve the right to update service prices without prior notice.
We accept payments via Visa, MasterCard, American Express, PayPal, Alipay, and Apple Pay. Alternate payment methods such as wire transfers may be arranged by request.
Payments are processed through secure third-party gateways. You agree to be bound by the terms and conditions of those providers during payment.
Refunds
All transactions are non-refundable, including but not limited to situations where:

The request is delayed by the government agency,

A request is refused or returned by the federal agency, i.e. IRCC, CBSA or CSIS,
-
Government processing timelines are extended.
Exception: If a refund request is made before submission of the request to the relevant agency, we may issue a partial refund at our discretion, subject to a 20% administrative fee to cover handling and processing costs. However, if the required consent form and documents are not received within 15 calendar days of placing the order, the request will be considered abandoned, marked as complete, and will no longer be eligible for a refund.
All refund decisions are final and solely at the discretion of GCMS Notes Request.
Legal Compliance & Limitations
You acknowledge that:

Our services are administrative in nature,

We do not guarantee the release of records, which is subject to the discretion of the government institution under the applicable Act,

We are not authorized immigration representatives under IRCC rules, and do not provide representation or advice in legal or immigration matters.
You are responsible for ensuring the information you provide to us is accurate and complete.
Disputes
We aim to resolve all concerns amicably and in a timely manner. If a dispute arises out of or in connection with our services, the parties agree to pursue resolution through negotiation or an alternative dispute resolution process before initiating legal action.
These terms are governed by and interpreted in accordance with the laws of Ontario, Canada. Any disputes will be subject to the exclusive jurisdiction of the courts of Scarborough, Ontario, Canada.
